Licence for educational social work services - application
General information
A licence from the Child and Youth Welfare Service (MA 11) is required for the operation of educational social work services. In order for the licence to be granted, the educational social work institution must have adequate human, spatial, organisational and financial resources to ensure the care and education of minors in keeping with Youth Welfare regulations and to guarantee the continuity of the service. These resources must be proven.

Requirements
- The legal entity operating the educational social work service may be a legal or natural person. The relevant persons involved may have no previous convictions for offenses related to youth welfare.
- The work must follow a concept for educational social work based on recognised scientific findings. The concept must be continuously updated to reflect new scientific developments.
- A cost estimation must be presented to demonstrate the economic feasibility of the centre. One of the requirements is a demand for the services of the institution. This demand must be proven.
- The head of education and social work of the centre must meet the following requirements: Diploma in educational social work, personal suitability for leadership, several years of work experience in child placement services.
- An adequate number of educational social workers must be available for the care and education of the minors.

Documents required
The following information is required in the application for a licence to operate an educational social work service:
- Educational social work concept
- For centres for children with special needs, a care concept is required as well
- Details on the target group and age structure
- Cost calculation (for the daily rate) using the following form: 14 KB XLSM (German)
- Details on the staff and their qualifications
- Floor plan of the building or flat indicating the size of the usable area, map showing the location of the building
- Documents relating to the ownership or other legal status regarding the property intended for this use (lease agreement, if applicable)
- For associations: Confirmation from the Office for Associations of the Austrian Federal Police, as well as the articles of association
- Police clearance certificates of the operators (members and representatives of the corporation) and the staff providing education and care
- For companies: Extract from the company register (German)

Means of redress or appeal
An appeal is possible against rulings issued by an authority and shall be filed by the party within a 4 weeks term with the authority that issued the ruling of first instance (against rulings without investigation procedure within a two weeks term). The term starts with the receipt of the written copy of the ruling, in the case of oral pronouncement simultaneously with it.
The appeal shall indicate the ruling it contests, the authority that issued the ruling and contain a motion of appeal with the reasons. No more appeal is admissible if the party expressly waived the right of appeal after receipt or pronouncement of the ruling.
Each ruling contains instructions on the right to appeal and indicates the authority and the deadline for submission of such appeal.
