Terms of Use - public WiFi service - "StadtWien-PublicWLAN"
Until further notice, the City of Vienna permits the free use of wireless Internet access provided at selected public locations via WiFi hotspots with the ID "StadtWien-PublicWLAN". The quality of the WiFi connection, in particular transmission speed and data transmission capacity, depends on factors like the user’s location and distance to the hotspot, the number of persons using the same hotspot simultaneously, structural and environmental conditions, and the terminal device used, as well as further interfering factors like dead spots, other WiFi networks, or interfering radiation sources, as well as other circumstances and influences. The City of Vienna provides WiFi access via the hotspots exclusively as a best-effort service; users have no right or claim to guaranteed quality or constant availability of the service.
User obligations
Hotspot users shall not endanger data security on the part of the City of Vienna or third parties, or access system functions or data on facilities operated by the City of Vienna or third parties. Users agree to use the hotspots for lawful purposes only, and to refrain from accessing or disseminating any content relevant under criminal law or infringing the rights of third parties. In case of violations, the City of Vienna shall be indemnified and held harmless by the respective user.
Further important notes
Users may only access the service after agreeing to the General Terms and Conditions (GTC) of the service provider. The agreement must be renewed after twelve hours.
Users may access the service as long as it is provided by the City of Vienna. The City of Vienna reserves the right to exclude individuals from using the service at any time, or to discontinue the service altogether.
Unavoidable signal interruptions (disrupting WiFi reception) may cause additional costs for the users, particularly when accessing charged websites or online services.
The City of Vienna is not able to guarantee the availability and smooth operation of the service, particularly given the fact that the frequencies used are also open to other providers and other technologies.
The user herby acknowledges the fact that Internet use and data transmission, in particular via WiFi, are associated with increased dangers and security risks. To ensure data security, we recommend using suitable software (e.g.: VPN), especially when accessing a company network via WiFi connection. The City of Vienna accepts no liability for unauthorised access to information and data transmitted via WiFi. To protect users and avoid misuse, content filters (blocklists) are used to restrict the content and services accessible via the WiFi connection. There is no right to unrestricted access.
The competent court at the seat of the City of Vienna, in the 1st district of Vienna, Vienna City Hall, shall be the sole place of jurisdiction for any legal disputes arising from the interpretation or application of the present Terms and Conditions. Austrian law shall apply, excluding the application of the UN Convention on Contracts for the International Sale of Goods (CISG).
